The online gaming industry in India is facing a massive shake-up following a landmark decision by the Supreme Court. The top court has upheld the government's decision to levy a 28% Goods and Services Tax (GST) on the full face value of bets placed on gaming platforms. This ruling is a major victory for the Directorate General of GST Intelligence (DGGI), which is now set to aggressively pursue tax recoveries totaling approximately ₹1 lakh crore.
For years, gaming companies have argued that the tax should only apply to the commission or 'rake' they charge, rather than the entire amount wagered by players. However, the DGGI had already issued show-cause notices to around 80 online gaming companies and casinos, alleging massive tax evasion. With the Supreme Court's backing, the tax department is now ready to move forward with recovery proceedings that could change the landscape of the industry.
One of the most notable cases involved Gameskraft, which received a record-breaking tax demand of ₹21,000 crore back in 2022. That case served as a template for many others, including high-profile names like Dream11, Mobile Premier League (MPL), Games24x7, and Delta Corp. These companies now face the daunting task of reviewing their balance sheets and recalibrating their business strategies to meet these heavy tax burdens.
Industry experts warn that the impact will be significant. Some smaller firms have already shut down due to the financial pressure, while larger operators are looking for ways to stay afloat under the 28% tax regime. While the revenue department has signaled it is open to discussing concerns regarding penalties and interest, the core tax demand is no longer up for debate. The ruling brings a sense of finality to a long-standing legal battle between the tech-heavy gaming sector and the nation's tax authorities.
