A dramatic turn of events unfolded in the R.L. Nithin Raj abetment of suicide case, as M.K. Ram, the primary accused, was arrested after weeks on the run, only to be ordered released by a court due to procedural errors, and then reportedly re-arrested moments later.
Dr. Ram, a former head of the Department of Dental Anatomy at Kannur Dental College in Anjarakandy, had been absconding since June 19, when the High Court dismissed his anticipatory bail plea. His appeal to the Supreme Court was also rejected on July 13, intensifying the search for him. Crime Branch officials had tracked him across states, including a previous lead to Chittoor in Andhra Pradesh, where he allegedly evaded capture.
He was finally apprehended by the Crime Branch in Perumbadi, Kodagu, Karnataka, on Sunday. After being brought to Kannur, his arrest was formally recorded on Monday morning. However, when he was produced before the Thalassery Principal District Sessions Court, a critical legal hurdle emerged.
The court declined to remand Dr. Ram in judicial custody and instead ordered his release. This decision stemmed from the investigating agency's failure to communicate the grounds of arrest to the accused, a requirement mandated by Supreme Court guidelines and Article 22 of the Constitution. Defence counsel B. Latheef highlighted this procedural lapse, leading to the court's order for release.
Despite the court's order, sources indicate that the Crime Branch was quick to act, reportedly re-arresting Dr. Ram immediately as he left the court premises. This swift re-arrest suggests that authorities are determined to pursue the case despite the initial setback.
The case revolves around the tragic death of first-year BDS student R.L. Nithin Raj.
