The Manhattan District Attorney’s Office has opened an investigation into Representative Eric Swalwell after a former aide alleged he engaged in sexual activity with her while she could not give consent following a night of drinking. The office has urged survivors and others with information to contact its Special Victims Division, signaling a formal inquiry rather than a conclusion to claims that have already sparked political debate. The case adds a fresh layer of tension to Swalwell’s gubernatorial campaign as questions about conduct surface alongside policy debates.
Swalwell has rejected the allegations, calling them politically motivated and a distraction from the race. She also alleged a separate incident in 2024 at an awards event in New York, after a meeting for drinks, where she said she became heavily intoxicated and later remembered only fragments of what happened.
