A significant plea has been filed in the Supreme Court, raising serious allegations against certain election officials and challenging decisions made within the Election Commission of India (ECI). The petition, filed under Article 32 of the Constitution, targets Gyanesh Kumar, a senior deputy election commissioner, Maneesh Garg, director general (IT) Seema Khanna, and potentially other officials.
The core of the allegations centers on what the petitioner claims are unauthorized modifications to Form 6, the form used for voter registration, and the centralization of electoral-roll databases. These actions, the plea asserts, were undertaken without the agreement of two other election commissioners, Vivek Joshi and Sukhbir Singh Sandhu.
Joshi reportedly noted in May 2026 that changes to the statutory form could not be made without amending the Registration of Electors Rules, 1960. Sandhu later described the change as "unauthorized and illegal." The plea also seeks prosecution under Section 32 of the Representation of the People Act, 1950, which deals with punishment for breaches of official duty related to electoral rolls.
Specific alleged violations include the failure to restore eligible voters through the ECINet system and the filing of a staggering 16.10 lakh appeals in West Bengal challenging voter inclusions, purportedly in the name of the ECI. In light of these serious concerns, the petitioner is seeking a comprehensive and independent judicial inquiry.
This inquiry would ideally be led by a retired Supreme Court judge, assisted by cybersecurity and IT experts, to conduct a forensic audit of the ECINet and ERONet databases. The plea also demands the immediate quashing of the alleged modifications to Form 6 and the restoration of the statutory form.
Furthermore, it calls for the preservation of all relevant server logs, databases, communications, and metadata related to ECINet and ERONet from October 1, 2025, until the investigation is complete.
