Court Blocks Trump's Bid to Keep Michigan Coal Plant Open! 🚨

A federal appeals court delivered a significant blow to the Trump administration on Friday, ruling that the Energy Department overstepped its legal authority in forcing a Michigan coal-fired power plant to stay open beyond its scheduled retirement date.

The 64-year-old J.H. Campbell Generating Plant was set to cease operations, but the Trump administration's Energy Secretary, Chris Wright, invoked emergency powers last year, claiming the plant was essential for regional electricity reliability. This intervention sparked a legal challenge from environmental groups and the states of Michigan, Illinois, and Minnesota, all seeking to overturn the orders keeping the facility active.

The U.S. Court of Appeals for the District of Columbia Circuit sided with the plaintiffs, unanimously concluding that no legitimate emergency existed under federal law.

Judge Cornelia Pillard, writing for the three-judge panel, emphasized that the provision of the Federal Power Act allowing emergency directives is a "narrow, last-resort backstop." Pillard noted that reversing the Campbell plant's "long and carefully planned retirement" was disruptive, with "no 'emergency' within the meaning" of the governing statute.

This ruling comes amidst several legal challenges across the nation against the Trump administration's use of emergency powers to prevent the closure of half a dozen coal-fired plants. Critics argue that these orders, which also affect facilities in Indiana, Colorado, Florida, and Washington state, are not only inflating utility bills but also contributing to avoidable air and water pollution.

Financial records reveal that keeping the Michigan plant operational beyond its initial May 2025 retirement date has already accumulated approximately $259 million in costs.
