SC Slams Magistrate Over Notice to Student Amid NEET-UG Protests!

The Supreme Court, on Wednesday, delivered a sharp rebuke to an Executive Magistrate from the Greater Noida Commissionerate for issuing a show-cause notice to a student from Gautam Buddha University. This incident occurred amidst the ongoing NEET-UG protests, despite the Supreme Court's clear earlier directive against taking coercive action on student protestors.

Chief Justice of India, Surya Kant, expressed strong disapproval, questioning how the Magistrate 'dared' to issue such a notice when the Supreme Court had previously quashed FIRs and barred fresh cases against students involved in protests related to the NEET-UG question paper leaks. The notice, issued to student Akshat Tripathi on September 4 under Section 130 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), accused him of 'spreading anti-government propaganda' and 'inciting' fellow university students to join a proposed demonstration by the Cockroach Janta Party (CJP).

Mr. Tripathi was ordered to show cause why he shouldn't be bound by a personal bond of ₹5 lakh, along with two sureties of the same amount, for allegedly instigating his peers. Senior advocate Biswajit Bhattacharya, representing Mr.

Tripathi, highlighted that the issuance of this notice was 'prima facie contempt' of the Supreme Court's September 1 order.

That order had specifically quashed FIRs against numerous student protestors and explicitly prohibited the registration of new FIRs in connection with the CJP protests. Following the Supreme Court's intervention, the Deputy Commissioner of Police (DCP), Greater Noida, confirmed via a social media post that the show-cause notice had already been withdrawn.

Furthermore, the DCP stated that the officials responsible for issuing the notice were facing disciplinary action, clarifying that the District Magistrate of Gautam Buddha Nagar had no involvement in the matter. This development underscores the judiciary's commitment to protecting the rights of peaceful protestors and upholding its own orders, sending a clear message to lower administrative bodies about judicial oversight.
