Chief Justice of India (CJI) Surya Kant issued a clear directive on Saturday, July 11, 2026: Artificial Intelligence (AI) serves merely as a procedural assistant in judicial processes, not as a decision-maker. This crucial clarification comes amidst growing concerns within the highest echelons of the judiciary regarding the perils of over-reliance on AI.
The CJI's caution follows recent incidents where courts encountered "AI-hallucinated verdicts" and citations to non-existent case laws. Earlier this month, a Bench led by Justice P.S. Narasimha identified a Tribunal that had used AI-generated fabrications to decide a real case, prompting the apex court to declare "zero-tolerance" for such sloppiness. This stance underscores a fear that blind trust in machine intelligence could catastrophically undermine the judicial process.
Draft Supreme Court rules already prohibit the use of AI for direct judicial outcomes or witness profiling. Justices B.V. Nagarathna and Dipankar Datta have openly shared experiences of encountering AI-generated legal fictions, including a fictitious case titled "Mercy versus Mankind," in petitions.
Chief Justice Kant, speaking at a summit organized by the Indian Institute of Arbitration and Mediation, emphasized that the question is not whether to embrace these tools, as their adoption is "already under way and cannot sensibly be resisted." Instead, the critical focus must be on establishing "legislative clarity and human oversight." This, he asserted, is vital to ensure that AI platforms genuinely broaden access to justice rather than inadvertently narrowing it, especially for those least equipped to challenge an algorithm's output. The judiciary's message is unequivocal: AI can be a powerful tool, but its application must be carefully managed to uphold the integrity and fairness of the justice system.
