A special National Investigation Agency (NIA) court has rejected the bail plea of Insha Jan, a key accused in the devastating 2019 Pulwama suicide attack that claimed the lives of 40 CRPF personnel. The court, presided over by Special Judge Prem Sagar, cited substantial material on record, indicating that the accusations against Jan are prima facie true. The statutory bar under Section 43-D(5) of the Unlawful Activities (Prevention) Act (UAPA) was also highlighted as a reason preventing her release at this stage.
Insha Jan, a resident of Harkipora village in Pulwama district, was arrested on March 3, 2020, along with her father, Peer Tariq Ahmad Shah. She is currently facing severe charges under various laws, including the Ranbir Penal Code (RPC), the UAPA, the Arms Act, and the Explosive Substances Act, with charges formally framed against her in December 2022.
According to the NIA's chargesheet, Jan was allegedly deeply involved in the terror conspiracy. She reportedly maintained constant contact with Pakistani terrorists Muhammad Umar Farooq and Mohd Kamran Ali, both of whom were instrumental in planning the Pulwama attack before being eliminated by security forces. Furthermore, she stands accused of providing food, shelter, and other crucial logistical support to these terrorists and other Jaish-e-Mohammed operatives. A critical piece of evidence cited is a viral video of suicide bomber Adil Ahmad Dar, which went viral post-attack, allegedly recorded at her house on January 28 and 29, 2019. The defence had argued for bail based on her prolonged incarceration, alleged trial delays, and health condition, but the NIA strongly opposed, emphasizing the gravity of the charges.
