The Allahabad High Court has delivered a significant verdict, affirming the fundamental right of an adult to choose their life partner and live according to their wishes. The court on Tuesday allowed a 26-year-old woman from Ghaziabad to leave her father's custody and reside with her Muslim husband.
The case involved Sonika Chauhan, who was presented before the court in compliance with an earlier order. Chauhan, who has completed her BA, stated clearly that she is 26 years old and has voluntarily married Akbar Khan. She expressed her strong desire to live with her husband and alleged that her father had confined her at home due to his disapproval of their marriage.
Akbar Khan also appeared before the court, affirming his willingness to live with Chauhan.
Her father, Lakshman Singh Chauhan, presented a counter-allegation, claiming that his daughter had been blackmailed by Khan and was acting under duress. However, after interacting with all parties involved, Justice Sandeep Jain underscored a crucial legal principle. The court held that once an individual has attained the age of majority, they possess the fundamental right to choose a life partner and fashion their life as they see fit.
This choice, the court emphasized, is deeply personal and cannot be dictated or controlled by the wishes or objections of parents or other family members. Consequently, the court declared that Sonika Chauhan is free to live with Akbar Khan. It further issued directives to the police, instructing them to provide adequate security to the couple.
The court also explicitly warned family members against interfering in their matrimonial life, reinforcing the protection of their personal liberty.
This ruling highlights the judiciary's role in safeguarding individual autonomy in matters of personal choice and marriage.
