OpenAI: Apple's Trade Secret Fight Is "Its Own Making"

OpenAI has strongly refuted Apple's allegations of trade secret theft, asserting that the iPhone manufacturer bears responsibility for the ongoing dispute. In a recent court filing in U.S. District Court in San Jose, California, OpenAI stated,

This dispute is a mess of Apple's own making, and it is trying to blame everyone else,

further claiming that Apple has failed to demonstrate any confidential information was stolen by former employees.

The legal battle intensified after Apple sued OpenAI and two former employees, Tang Tan and Chang Liu, in July. Apple accused them of misappropriating trade secrets related to hardware design, manufacturing, and supply-chain operations, particularly as the ChatGPT maker expands into consumer devices. OpenAI, led by CEO Sam Altman, views Apple's lawsuit as a tactic to slow down a potential competitor and deter employee departures.

Court filings indicate that OpenAI has hired approximately 400 employees from Apple for its hardware initiatives. OpenAI's defense highlights California law, which permits employees to freely move between rival companies.

Furthermore, OpenAI contended that Apple's own policies complicate matters, stating that the company encourages employees to use personal iCloud accounts for work documents, making it difficult for departing staff to distinguish between personal and corporate information. OpenAI also pointed out that Apple's policy of immediately escorting departing employees from its premises does not allow them sufficient time to properly manage their data.

This lawsuit marks a significant escalation in tensions between the two tech giants. Just two years prior, Apple and OpenAI had forged a partnership aimed at broadening ChatGPT's reach and strengthening Apple's position in the AI sector.

However, the relationship quickly deteriorated as the competitive landscape in the AI industry grew more fierce.
