SC Halts TN Cow Slaughter Ban! Major Legal Win For State Govt?

The Supreme Court has stepped in, putting a hold on the Madras High Court's earlier directive that sought to impose a complete ban on cow and calf slaughter across Tamil Nadu. This significant decision, made on Monday (July 13, 2026), comes after the Tamilaga Vettri Kazhagam (TVK) government challenged the High Court's May 27 order.

The Tamil Nadu government argued before a Bench comprising Justices Vikram Nath and Sandeep Mehta that the Madras High Court's blanket ban was contrary to existing State laws. Specifically, they cited the Tamil Nadu Animal Preservation Act, 1958, which allows the slaughter of cows over 10 years old if a competent authority deems them unfit for work or breeding.

Further, the State government highlighted that other relevant laws, including the Prevention of Cruelty to Animals Act, 1960, and the Prevention of Cruelty to Animals (Slaughter House) Rules, 2001, do not mandate a complete prohibition. Instead, these laws regulate the conditions and manner in which slaughter can be carried out. The government contended that the High Court's order amounted to "judicial lawmaking" and was inconsistent with these established legal frameworks.

The Supreme Court bench agreed that the Madras High Court's impugned order prima facie required "correction." They issued notice on the appeal filed by the Tamil Nadu government and stayed the operation of the High Court’s order, specifically the part that directed a complete ban on cow slaughter. This temporary stay means the State will not have to enforce the blanket ban while the matter is further deliberated. The original writ petition before the High Court was moved by K. Surya, also known as K. Surya Prasanth, youth wing secretary of the Indu Makkal Katchi.
