LIC Housing Finance Ltd (LICHFL) is facing a massive financial setback following a recent National Company Law Tribunal (NCLT) decision concerning the insolvency proceedings against Essel Group founder Subhash Chandra. The housing finance company is set to receive a mere Rs 38.09 lakh against an admitted claim of a staggering Rs 1,322.39 crore. This represents a drastic reduction, often referred to as a "haircut," for the lender.
The significant cut comes as part of a repayment plan approved by the NCLT.
LICHFL had extended financial facilities under two separate loan accounts where Subhash Chandra had provided a personal guarantee.
Despite this drastic reduction in the payout, LIC Housing Finance has stated that it retains its rights and security interests over the assets against which these loans were initially secured.
This development is part of a broader resolution process for Subhash Chandra's debt. Days before this specific NCLT approval, reports indicated that creditors would receive only a fraction of the total ₹22,006 crore claimed from him. Chandra himself has previously stated that the Essel Group repaid ₹43,000 crore of debt and has sought an independent audit to examine his overall debt situation.
He also mentioned plans to "work with friends in Switzerland," hinting at future endeavors.
The NCLT's approval of such a repayment plan raises questions and concerns among financial institutions regarding the recovery of large debts, especially when personal guarantees are involved. While the legal process aims to resolve insolvency, the substantial reduction in the claimed amount highlights the challenges faced by lenders in these complex cases.
