India is ushering in a new era for online shopping with amended Consumer Protection (E-Commerce) Rules, set to become operational from January 1, 2027. These significant changes aim to safeguard consumer interests in the rapidly evolving digital marketplace, offering greater transparency and protection against misleading practices like "dark patterns" and hidden fees.
Under the new regulations, e-commerce platforms will be required to disclose crucial information to consumers. This includes the legal name of the entity, the principal geographic address of its headquarters and all branches, as well as contact details like email, landline, and mobile numbers for customer care.
A dedicated grievance officer's details must also be provided, who will be mandated to acknowledge consumer complaints within 48 hours and resolve them within a month, a major win for shoppers seeking quick redressal. Transparency in pricing and product information is another cornerstone of the new rules.
When offering discounts, e-sellers must clearly display the "prior price" of goods or services alongside the reduced price.
This prior price will be based on the lowest price offered during the preceding 30 days, preventing artificial price inflation before sales. Furthermore, sponsored product listings must be distinctly identified to avoid confusion. To tackle deceptive practices, the rules explicitly state that every e-commerce entity must comply with the Guidelines for Prevention and Regulation of Dark Patterns, 2023.
This includes conducting a yearly self-audit to ensure platforms are free from such manipulative designs, with a compliance certificate prominently displayed. For imported goods, platforms will also need to disclose the importer's details and the country of origin, adding another layer of clarity for buyers.
Additionally, marketplace e-commerce entities will be restricted from collecting "bundled fees" for services unrelated to the e-commerce platform itself, with exceptions for legitimate loyalty or membership programs. These comprehensive amendments are designed to empower consumers, foster fair trade practices, and build trust in the digital retail ecosystem, ensuring a more secure and transparent online shopping experience for everyone.
