The Supreme Court has taken a significant step by issuing a notice to T.K.
Anil Kumar, the Secretary of School Education in the Ministry of Education.
This comes after a contempt plea was filed alleging non-compliance with a previous court order regarding the regulation of educational and religious institutions for children under the age of 14.
The bench, comprising Justices Dipankar Datta and Sheel Nagu, has given the secretary four weeks to respond. The contempt plea was brought forward by advocate Ashwini Kumar Upadhyay, who claims that despite a directive from the top court on May 11, no action was taken on his representation.
Upadhyay's original plea sought directions for the government to register, recognize, supervise, and monitor all institutions providing secular or religious instruction to children up to 14 years old. This initiative is rooted in the spirit of Articles 21A, 39, 45, and 51-A of the Constitution, which emphasize the state's responsibility towards children.
The advocate highlighted critical concerns, stating that children, due to their tender age, are vulnerable and can be easily manipulated or brainwashed in unregistered institutions. He emphasized that this issue isn't just about education but also a matter of national security, as these young children are the future of the nation.
Upadhyay further claimed to have found numerous unregistered and unrecognized institutions operating, particularly in border areas of Uttar Pradesh, without any effective oversight or regulatory mechanisms.
