The Delhi High Court has directed activist Sonam Wangchuk, currently on a 24-day hunger strike, to be immediately transferred from Safdarjung Hospital to Medanta Hospital in Gurugram. This crucial decision, made on Tuesday, July 21, 2026, aims to ensure Wangchuk's safety and protect his fundamental rights amid growing concerns over his health.
Wangchuk's hunger strike is in solidarity with student protests against the alleged NEET paper leak, a national issue that has garnered significant public attention. His commitment to the cause has led to a prolonged protest, taking a toll on his physical well-being.
The court's ruling came after an appeal filed by Mr. Wangchuk's wife, Ms. Gitanjali J. Angmo. A Bench comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia noted serious medical concerns identified during interactions with doctors from AIIMS and Safdarjung Hospital. Specifically, doctors highlighted dangerously low TLC (Total Leukocyte Count) and potassium levels in his blood samples, necessitating "constant and continuous monitoring" by medical experts.
Senior Advocate Kapil Sibal, representing Ms. Angmo, argued that the case involved a violation of Mr. Wangchuk’s fundamental rights, as guaranteed under Articles 19 and 21 of the Constitution. The Centre, through Solicitor General Tushar Mehta, informed the Court that it had "no objection" to the transfer, provided all necessary medical details from Safdarjung Hospital are supplied to Medanta, and a panel of doctors oversees his care at the new facility.
Considering the submissions from all parties and the unanimous medical opinion, the Court concluded that the transfer to a hospital of Mr. Wangchuk's choice was essential. This decision underscores the judiciary's role in safeguarding an individual's health and rights, even during acts of protest. The move to Medanta Hospital is expected to provide him with the specialized care required for his condition while his protest continues to draw attention to the serious allegations surrounding the NEET examinations.
