SC Urges Govt to Embrace Simplicity, Cut Red Tape
Supreme Court calls for simpler administration and fewer hurdles for citizens, warning excess rules invite scrutiny and hinder justice.
The Supreme Court, in a judgment dated December 5, 2025, urged governments to embrace simplicity in administration, arguing that excessive rules and laws burden ordinary citizens and disturb the peace of mind. Justice P.S. Narasimha, who authored the decision, wrote that simplicity in public transactions is good governance and that administrative procedures should be clear, straightforward, and easy to understand.
The Bench warned constitutional courts are empowered not only to strike down illegal executive decisions but also to scrutinize those based on irrelevant considerations that impose unnecessary burdens and slow down transactions. It emphasized that laws should facilitate, not hinder, access to justice, noting that unnecessary demands waste time and resources.
On the concrete case before it, the Court struck down a 2009 directive of the Jharkhand government that imposed superfluous, unnecessary hurdles on cooperative societies seeking stamp-duty exemptions. The judgment underscored that administrative rules must avoid complexity and avoid imposing needless administrative burdens.
The Court framed simplicity as a core ingredient of the rule of law and access to justice, defining administrative simplicity as laws, regulations, and procedures that are clear, straightforward, and easy to understand, enabling effortless compliance. The judgment signals a push toward governance that respects citizens’ time and resources, while preserving legitimate safeguards.
