Delhi HC Orders Platforms to Act in 7 Days on Pawan Kalyan's Personality Rights
Delhi High Court directs social media intermediaries to act within seven days on Pawan Kalyan's plea to safeguard personality rights amid AI videos and impersonation online.
Delhi High Court on Friday directed social media intermediaries to act within seven days on Andhra Pradesh Deputy Chief Minister Pawan Kalyan's plea seeking protection of his personality rights. The bench noted that the politician has already approached the intermediaries with grievances and asked them to treat his complaint under the Information Technology Rules, 2021. It also asked platforms to inform him if they have reservations about any links.
The advocate for Kalyan said the issues include AI-generated videos of him circulating on Google, impersonation, and fake association content on Meta and e-commerce platforms. The court directed the plaintiff to provide URLs within 48 hours for takedown and listed the matter for further hearing on December 22. Kalyan, who heads the Jana Sena Party, seeks to prevent unauthorized use of his name and images and to protect his right to publicity, i.e., his personality rights.
In a related line of rulings in similar matters, earlier, the court clarified in a case involving actor Ajay Devgn that plaintiffs must first protest to social media intermediaries and then approach the court for relief. The judge emphasized that personality rights cover the right to control and profit from one’s name, likeness, or image, and that platforms have a duty to respond promptly to such requests.
