Kolhapur Bench Quashes Rejection of Nomadic Tribe Peon Appointment
Kolhapur bench rules post-2011 norms can't be applied retroactively to a 2011 Nomadic Tribe appointment and directs approval within four weeks.
The Kolhapur Bench of the Bombay High Court, on Thursday, November 27, 2025, set aside an Education Officer’s 2018 order that rejected approval for the appointment of a peon at Arjun Ravrane Vidyalaya, Vaibhavwadi. The court held that government resolutions issued after the 2011 appointment could not be applied retroactively and directed the approving authorities to grant the necessary approval within four weeks.
The case was filed by Satywan Kale, who was appointed as a peon at Arjun Ravrane Vidyalaya in Vaibhavwadi under the Nomadic Tribe-C category on August 1, 2011. The Education Officer (Secondary), Zilla Parishad, Sindhudurg, had rejected Kale’s approval proposal on August 21, 2018, citing lack of prior permission, non-compliance with advertisement norms, and absence of staffing-pattern approvals, relying on a Government Resolution dated February 6, 2012 that introduced new recruitment conditions. Kale’s advocate argued that the appointment was made following due process and that the school management submitted the proposal for approval accordingly.
The school management contended that due process had been followed and that even if queries were raised, they could have been resolved earlier. The court’s ruling emphasizes that policy changes enacted after an appointment cannot derail an otherwise valid appointment and that approvals must be granted under the norms in place at the time of appointment. The decision directs the Education Officer to finalize the approval within four weeks, underscoring the protection of existing appointments from retroactive policy shifts.
