The Supreme Court, in a significant move on Tuesday, August 4, 2026, has issued a comprehensive directive aiming to combat the rising menace of "digital arrests" scams and cyber fraud. This detailed order mandates the Centre, State governments, the Reserve Bank of India (RBI), and telecom authorities to establish Standard Operating Procedures (SOPs) and robust mechanisms for victims. The goal is clear: to redress grievances, initiate criminal action through zero FIRs against fraudsters, and ensure time-bound restoration of monetary losses for those defrauded.
The court acknowledged a status report from the Indian Cyber Crime Coordination Centre (I4C) under the Ministry of Home Affairs, which presented encouraging statistics. Complaints related to "digital arrests" on the National Cyber Crime Reporting Portal have seen a sharp decline, from 123,672 in 2024 to 58,249 in 2025, further dropping to 16,377 by June 30, 2026. While these figures are positive, the Supreme Court stressed the ongoing necessity to closely monitor the situation to prevent new forms of fraud from emerging.
Significant progress has already been made on several fronts. A data-sharing Memorandum of Understanding (MoU) was signed between the Reserve Bank Innovation Hub and I4C on May 11, 2026. The grievance redressal mechanism portal has expanded its reach to cover 123,590 branches across 69 banks. Furthermore, the Money Restoration Mechanism Portal is now active with 57 participating banks and serves all 36 States and Union Territories, having successfully restored an aggregate amount of ₹18.05 crore in 36,290 cases.
The court also highlighted advancements in law enforcement tools. The e-Zero FIR mechanism is currently operational in 19 States, though only 14 States have formally notified their State Cyber Crime Coordination Centres. On the legislative side, the Telecommunications (Radio Equipment Possession Authorisation) Rules, 2025, have been notified, and the Telecommunications (User Identification) Rules, 2025, are in their final stages of notification. The CBI is actively investigating, having registered 10 digital arrest cases and several related incidents, demonstrating a multi-faceted approach to tackling this sophisticated form of crime.
