Journalist's Fight: SCOTUS Upholds Fine for Protecting Sources!

In a significant development for press freedom, the U.S. Supreme Court has declined to intervene in a case where former Fox News reporter Catherine Herridge faces an $800-a-day fine for refusing to disclose her confidential sources. The legal battle stems from a series of articles Herridge published in 2017 while at Fox News. These reports focused on Chinese American scientist Yanping Chen, who was under FBI investigation but never formally charged. Herridge’s stories delved into Chen’s alleged ties to the Chinese military and questioned whether a professional school she founded in Virginia was being used to gather information for the Chinese government concerning American servicemembers.

Chen subsequently filed a lawsuit against the government, alleging that information about her investigation was leaked. It is as part of this lawsuit that the demand for Herridge to reveal her sources arose. Her refusal led to the civil contempt ruling and the imposing of daily fines. Chief Justice John Roberts had previously issued a temporary hold on the fine while the Supreme Court reviewed Herridge's emergency appeal, but that hold has now been lifted. Justice Brett Kavanaugh was the lone voice supporting the application for a stay, indicating a division within the court on this critical issue.

The articles in question reportedly relied on leaked materials from the FBI’s probe into Chen, including snippets of an FBI interview summary, personal photographs, and details from her immigration forms related to her involvement in a Chinese astronaut program. This Supreme Court decision sends a chilling message to journalists across the country, highlighting the persistent challenges faced in protecting confidential sources, a cornerstone of independent investigative journalism.
