SC Halts "Witch-Hunt" Against Rahul Gandhi in Assets Case! #NaturalJustice
Big relief for Rahul Gandhi! Supreme Court steps in, halting "disproportionate assets" proceedings initiated by Allahabad HC. Citing natural justice, SC questions HC's methods.
The Supreme Court on Monday, August 17, 2026, delivered a significant directive, ordering an immediate halt to the disproportionate assets proceedings against Leader of Opposition Rahul Gandhi. These proceedings were initially initiated by the Allahabad High Court, but the apex court intervened, stressing the fundamental importance of "principles of natural justice".
A three-judge Bench, presided over by Chief Justice of India Surya Kant, weighed in after submissions from senior advocate Kapil Sibal and advocate Prasanna S., representing Mr. Gandhi. They argued vehemently that the High Court proceedings, along with its subsequent directions for the Central Bureau of Investigation (CBI) and Directorate of Enforcement (ED) to investigate allegations made by private complainant S. Vignesh Shishir, amounted to nothing short of a "witch-hunt".
Mr. Sibal highlighted several procedural irregularities in the High Court's handling of the case. He pointed out that the proceedings were conducted in-chamber rather than in open court, and records were kept under sealed covers. Crucially, Mr. Gandhi was not afforded the opportunity to present his side or be heard on the allegations leveled against him, a clear violation of natural justice.
Chief Justice Kant addressed Additional Solicitor General S.V. Raju, who was representing the CBI counsel, stating, "If the courts want to issue directions [for inquiry/investigation], the courts are expected to fulfill the principles of natural justice." This statement underscored the Supreme Court's concern over the procedural fairness of the High Court's actions.
While acknowledging the Supreme Court's stance on procedural fairness, Mr. Raju maintained that the core allegations in Mr. Shishir’s complaint were serious. He stated that while the facts might be right or wrong, "but if the facts are right, it is a gross case of disproportionate assets." The law officer, who also represents the ED, emphasized the gravity of the allegations, even as the Supreme Court paused the inquiry to ensure due process. This development marks a major legal and political turn for Rahul Gandhi, bringing temporary relief while highlighting critical questions about judicial procedure.
