Karnataka HC Quashes BJP’s Defamation Case Against Rahul Gandhi

The Karnataka High Court on Tuesday quashed all proceedings against Congress leader Rahul Gandhi in a defamation case filed by BJP over newspaper advertisements ahead of the 2023 Karnataka assembly elections. Justice S Sunil Dutt Yadav allowed Gandhi's petition seeking quashing, saying that continuing the proceedings would amount to an abuse of the process of law and that the proceedings against Gandhi are set aside.

The defamation case was filed by BJP leader Keshav Prasad against Gandhi, then-chief minister Siddaramaiah and deputy chief minister DK Shivakumar, citing advertisements and campaigning slogans of the Congress party during the lead-up to the 2023 elections. The BJP had alleged that the Congress had run ads accusing the BJP government of charging up to 40 percent commission from contractors for public works, and had sought action against Gandhi and others. Gandhi, Siddaramaiah, and Shivakumar were granted bail by a magistrate court in June 2024.

Political and legal observers say the ruling narrows the scope of defamation actions tied to political advertising, emphasizing that court proceedings should not be misused to pursue political ends.
