SC Upholds Free Speech in Karur Stampede Case: No Gag Order on TVK Leaders!
Supreme Court rejects DMK's plea to silence TVK leaders over Karur stampede remarks, emphasizing 'more speech' over judicial curbs. A crucial ruling on free speech and political discourse.
The Supreme Court on Tuesday issued a significant ruling concerning the Karur stampede case, stating it would not restrain leaders of the Tamilaga Vettri Kazhagam (TVK) from making public statements linking political rivals to the tragic incident. The court emphasized that such a move could amount to an injunction on free speech.
The Bench, headed by Justice K.V. Viswanathan, advised the Opposition Dravida Munnetra Kazhagam (DMK) to counter any alleged false statements with “more speech” rather than seeking judicial intervention to silence opponents. This came during the hearing of an application filed by DMK Organising Secretary R.S. Bharathi.
Mr. Bharathi’s plea sought to restrain TVK leaders, including Aadhav Arjuna, from making what he described as “false accusations of criminal liability” and issuing “threats” against political opponents regarding the Karur stampede. He had also requested to be impleaded as a party in the ongoing Karur stampede case before the Supreme Court.
Justice Viswanathan questioned the legal basis for restraining speech and strongly stated that the court should not be converted into a political forum. He highlighted that political battles should be fought through public discourse, not judicial means. Senior advocate Ranjit Kumar, representing Mr. Bharathi, argued that TVK leaders, some of whom are accused in the stampede case under CBI investigation, should be barred from commenting while the probe is ongoing. However, the court remained firm on its free speech stance.
The Karur stampede, a tragic event that occurred during a TVK rally on September 27 last year, resulted in the deaths of 41 people and left 142 injured. The apex court had ordered a CBI investigation into the incident on October 13, 2025, which is still continuing, and some TVK leaders have indeed been named as accused. Following the Supreme Court's clear position, Mr. Bharathi subsequently withdrew his impleadment application.
This ruling underscores the judiciary’s commitment to upholding free speech principles and preventing courts from being used as a battleground for political rivalries, instead urging political parties to engage in open debate.
