SC Grants CBI Free Hand to Probe Digital Arrest Scams Across India
Supreme Court empowers the CBI to probe digital arrest scams nationwide, enabling bank data access, Interpol cooperation, and AI-based checks on accounts.
The Supreme Court on Monday granted sweeping powers to the Central Bureau of Investigation (CBI) to probe digital arrest scams across the country, directing states and Union territories to grant sanction for investigation under the Delhi Special Police Establishment Act. The bench also asked the RBI to respond on using artificial intelligence or machine learning technology to identify and freeze bank accounts used by cyber criminals as part of the effort. The directions come in a suo motu proceeding they initiated on October 17, signaling a major intensification of the fight against scams where fraudsters impersonate officials to intimidate victims, often elderly, into paying money.
Under the order, the CBI will have a free hand to probe, including actions against bank staff believed to be complicit in opening new accounts used to channel fraud proceeds. The court said the agency could seek assistance from social media intermediaries and telecom operators to gather necessary information about suspects and their networks, highlighting the cross-platform nature of these crimes and the need for rapid information sharing across agencies.
Law-enforcement officials will also be asked to coordinate with Interpol to identify cybercrime hubs abroad and crack down on operations that affect India. The RBI is expected to explore AI tools to detect suspicious patterns and help prevent misuse, while there is a push to improve SIM card issuance norms and establish state-level cybercrime coordination centers to speed up investigations.
The decision, viewed as a decisive step against digital fraud, emphasizes the need for speedy sanctions, information sharing, and cooperation across agencies and borders. It also underscores the vulnerability of elderly victims who are often targeted by such scams, and the urgency of swift action to curb the fraud ecosystem.
Overall, the judges underscored that digital arrest scams require immediate attention and a robust investigative framework, marking a turning point in India's cybercrime strategy.
